Challenges of Life

Some of Life’s Challenges Education has always played one of the most challenging parts of my life. It has become even more of a struggle with the other priorities in my life such as work and my hockey club team. I always try my best to get around to these events while at the same time, try to avoid the worst possibilities-like not having a source of transportation or falling behind schedule with another event. These issues of rides and time can occur often but I do learn to work with what my sources are, which is hardly anything, and somehow manage to be okay at the end of the day.To begin with, working is a huge responsibility and sometimes can be a bigger priority than school. I work all morning shifts which keeps me from having any classes in the daytime. In addition, the morning time at the Galleria Mall is slow but the regulars are always there early, sometimes before the mall even opens, and it becomes frustrating when trying to concentrate on my work with a customer wa lking in every other minute.This causes me to lose my train of thought, which you all know can be very thwarting. Last, but worst part is that when I get off work, I have class right after! I come to class grumpy, hungry, and hardly without a desire to learn anything. For quite some time now, cars have been a huge hobby as well as a passion of mine. Just 45 days after the September 11 attacks, with virtually no debate, Congress passed the USA Patriot Act on October 5th, 2001. This act expanded the surveillance powers of domestic law enforcement and international intelligence agencies. The controversy that must be discussed is whether or not this legislation fully or in part has violated the Constitution and/or endangered our civil liberties in any way. John Kerry former presidential candidate is opposed to the patriot act stating ?We are a nation of laws and liberties, not of a knock in the night. So it is time to end the era of John Ashcroft. That starts with replacing the Patriot Act with a new l aw that protects our people and our liberties at the same time.? John Kerry is right in suggesting that the patriot act is thinning our freedoms. However, if the Bush Administration continues to advocate such measures as the Patriot Act, then an important question is raised: Who will protect us from our own government? I conclude my stance with a quote from Senator Russel Feingold the sole senator who voted in opposition to the USA Patriot Act, Feingold passionately states ?Preserving our freedom is one of the main reasons that we are now engaged in this new war against terrorism. A Response to 2001: A Space Odyssey I love having the Blue Danube waltz in 2001; it's my favorite part of the movie. What I find most amusing about it is that it ties in so well with the smoothness of a space orbit. In the first space scene, anything that is free floating, like the pen or the ships themselves, is perfectly in balance with the music. Nothing in orbit is ever rushed, and at no time does it ever falter from its halcyon state of existence. The Blue Danube matches this perfectly, and it contrasts sharply with the forced human stellar endeavors that are also present. For example, when the attendant is attempting to walk along the spacecraft aisle, she looks like a toddler who is just learning to walk, and the music that accompanies her is so sublime and unencumbered. Even the pen she is reaching toward looks like a champion athlete in comparison to her awkward movement. On one level, this can be seen as a symbol for the general idea of humans fighting with nature itself. Humanity has always tried to se parate itself from the "beasts;" we have intricate eating customs that involve utensils, we wear clothes that are much more intricate than those that would be required by basic needs, and most importantly, we do everything we can to make our societies totally disconnected from nature. If this message is, in fact, a part of Kubrick's statement, then it is directly comparable to Nietzsche's ideas on science and technology. Specifically, I refer to the story on science in "Thus Spoke Zarathustra," where Zarathustra discusses the aspect of science that acts as a security blanket for mankind. As a race, we develop theories and inventions to understand our existence and force our e... ... though. Specifically, he makes me dread the scenes that showcase his creations of strife and pain. If Kubrick intended me to raise my blood pressure during the first space-monolith scene, then his use of Ligeti did the trick. Maybe that's exactly what he intended. Maybe he was trying to communicate the anguish that is inherent to the change embodied by the monolith or the incomprehensibility that overwhelms our imaginations if we think too hard about the infinite stretch of space. Or, maybe he just wanted something that made those particular scenes stick out and appear ripe for interpretation in any of numerous ways. Either way, regardless of the intelligence at work in the non-Strauss scoring, I still viscerally liked the Strauss and not much else musically. That's ok, though, because the Blue Danube and the introduction to Thus Spoke Zarathustra are just that good.

From the sandlot to stadiums seating over fifty thousand people, the game of baseball has provided people of all ages with a common foundation; a sport we can all call our national pastime. Though its concept sounds simple, a game using a ball and a bat, millions of people all over the world have sought involvement in it by either playing at some level, or just sitting back and watching a game. With professional baseball attracting more and more fans each season, no one knows what limits this sport can reach. For the time being though, it has been a real "home run." Like any other sport, baseball developed over an extended period of time spanning way back to the 1600’s. The first evidence of the sport was a game called rounders, which was played in England (Lewine 27). Players hit a ball with a bat, which is parallel to today’s game, but the method’s to how the defense put the runners out was the big difference. Similar to dodge ball, an infielder or outfielder had to throw the ball at the runners. If the ball hit a runner who was off base, he was out. This formula was called plugging and soon after, its popularity ceased as did the game’s (29). Soon after, a transition occurred and the name rounders changed to town ball and then to Massachusetts’s game, and finally the name baseball, developed by American colonists, stuck. Rules did change over the period of them the names did, such as the number of players, distance between bases and etc. Around 1840, the Americans solidified the rules and rounders had become baseball. Even with evidence that baseball developed from rounders, it is believed that a United States Army general named Abner Doubleday invented the sport in Cooperstown, New York, current home of the Hall of Fame (30). After many disputes, Albert Spalding, a sporting-goods manufacturer and player of baseball, decided to have a commission decide who originated the game. In 1908, the commission credited Doubleday with creating the game and it was based on a letter from Abner Graves, a friend of Doubleday’s. In this document, Graves stated that he had been present as Doubleday conceptualized the game in 1839 (30). As a result of this decision, historians research concluded that Doubleday had little to do with the discovery of baseball and his friend Graves described plugging in the letter, that being a major fundamental in rou... ...ood as a record for 38 years until these two men belted 70 and 66 home runs respectively. Can this major record-breaking predict what professional baseball players have to offer us in the future? Well, we can safely assume that baseball into the new millenium can only bring us the same excitement that it has for the past hundred or so years. After all, it is still designated as our national pastime. For centuries, baseball has changed drastically whether it be the players, teams, records, and all the like. While all things change though, and as it is stated "the only thing that is constant is change," one thing has remained the same throughout its duration as one of the major sports (McCarver 209). It has united people in times of good and bad, and for that reason was coined our national pastime. You can find thousands of kids each Saturday during the spring at little league games. You can see a stickball game proceeding at a local park. You can even sit in an air-conditioned room in front of the television watching the "Game of the Week." With the millions of people involved in baseball in some way or another, there is no wonder why it is called our national pastime.

Extra Credit Assignment MILK 1. What are the main themes, politically and socially, that are portrayed in the film? Milk is a biographical film based on the triumphs and struggles of Harvey Milk. He was a gay rights activist and the first openly gay elected official in California. Socially, the film addresses the discrimination homosexuals faced on a daily basis. â€Å"(T)he normal majority†, as labeled by Anita Bryant, inflicted prejudice upon the homosexual minority. â€Å"The Castro†, the name of a street in an area often inhabited by homosexual bars and such places, portrays the clan like social groupings.The entire neighborhood however was not friendly. A fellow merchant on Castro Street refused to allow Milk to join the Merchant’s Association and even threatened to call the police and have his business license revoked on no legal grounds. Homosexuals were often portrayed as social deviants and often faced severe police brutality. The film addresses many pol itical issues, as it is centered on the gay rights movement. Milk faces multiple loses at the voting polls before making it as a member of the San Francisco Board of Supervisors. The quote, â€Å"I am not a candidate, I am part of a movement. In the face of defeat he often said that its not only about winning, it’s about making a statement and getting the attention needed for change. In the film, Harvey Milk stated, â€Å"almost everything was done with an eye on the gay movement†. He compared it to the civil rights movement of the African Americans.He said that they had a leader and a successful movement and it was time for homosexuals to have the same. Like other civil rights movements, the gay rights movement created legal and social reform. It brought awareness to inequality among equal beings. Milk also stated that he didn’t want to limit himself to gay rights. He also wanted to include blacks, Asians, and the disabled in a human rights movement. 3. Choose 2 scenes from the film and discuss what is important about them. I was very bothered by the comments Anita Bryant made during a televised speech that was shown in the film.She was an orange juice sales woman who was working to repeal laws that protect homosexual human rights; specifically in employment and housing. She described homosexuality as â€Å"tearing down the foundation of the family unit† and compared gays to prostitutes and thieves. She tried to convince the public that the traditional family was being threatened and that practicing or accepting homosexuality was blasphemy. Although the scenes of Harvey Milk recording his voice were split up throughout the film, I felt it to be the most powerful.Not only does he address the substantial probability of being assassinated, he does so calmly and courageously. He stated that, â€Å"a gay activist is the target for someone w ho is insecure†. As he did throughout his encounters with all kinds of people, he also stated that he often broke the tension when giving a speech to mostly straight men by telling a joke. Milk accomplished a lot for the gay rights movement, one that is still fighting today, and he did so with integrity, hard work, and sporadic humor. 4. What did you like best/ and or least about the film? What I liked best about the film was Milk’s personal character.He was stubborn and kind at the same time. He also exudes his kindness in both his personal relationships and political affairs. His angry and determined moments on the campaign were balanced out by his romanticism in his personal life. 5. What did you learn that you did not previously know about the time period of the film? I was shocked to learn of the police brutality during this time period. In the very beginning of the film, as the credits are running, newspaper headlines are shown in the background. The articles were about people being arrested for absurd charges. For example, a bartender was arrested for serving alcohol to homosexuals.

Since time immemorial, it has been a common notion that wealth defines a person’s status in the society. It is usually associated with the amount of material things that a person owns that wealth is determined. This essay would try to evaluate the advantage of wealth in the light of the novels ’ Hedda Gabler’ by Henrik Ibsen and ‘The Great Gatsby’ by Francis Scott Key Fitzgerald.A discussion of the basic concept of wealth in each novel will first be identified. A deliberation on the advantage of wealth in each novel will be highlighted. Lastly, the essay will compare the ideas in the two novels to establish the significance of wealth.The Great Gatsby, narrated through the eyes of Nick Carraway, denotes his enthusiasm to the life of his neighbor Jay Gatsby. The novel is a love story on the surface with the concept of betrayal and true love emanating from each chapter. As can be reiterated, the novel tries to undermine the fact that ‘money is tantamount to power and authority in the society’.  Basically, the novel is about the pursuit of Daisy’s love by Jay Gatsby and the means that Gatsby had used to attain his goals. It is noted that Jay and Daisy had been in love prior to her marriage to Tom. Jay had to leave because of war but they promised each other that they will someday marry and live together.Nonetheless, when Jay came back, he discovered that Daisy had married a rich and wealthy man, Tom Buchanan. Gatsby’s dream is to be with Daisy forever and to win back Daisy’s love. Since Daisy is a woman of aristocratic heritage, it is a prerequisite for him to be rich and famous to be able to succeed her love. Thus, Jay Gatsby has been blinded by money. His dream has been based on the acquisition of money, fortune and fame due to the belief that material wealth can bring back everything.  To further emphasize this viewpoint, it can be helpful to understand some quotes from the novel itself. In a statement when Gatsby imagined that Daisy will divorce Tom, he uttered ‘I’m going to fix everything just the way it was before (Fitzgerald, p. 111)’.This statement holds his faith to his wealth; it shows that despite everything, he believed that money can still fix everything. When Nick advises him that ‘you can’t repeat the past’, Gatsby replied ‘Why, of course, you can (Fitzgerald p. 111)’.   The conversation further reveals Gatsby’s confidence in the power of wealth and determination towards what he wants.One of the most exquisite remarks that Jay Gatsby had uttered is that ‘Her voice is full of money (Fitzgerald p. 144)’, in reference to Daisy. Gatsby is aware of the fact that his love for Daisy is based on attraction towards wealth. In this regard, Gatsby believed that money can substitute love since Tom had substitute Jay’s place in Daisy’s heart. Like money, love is something that needs to be acquired which determines the purpose of being for Jay. Everything that Jay spends is a way towards fulfilling his dream.Daisy on the other hand displays the significance of wealth when she married Tom Buchanan despite the fact that she is not in love with him. The novel hinted the interest that Daisy still have for Jay after all the years when she inquired ‘What Gatsby?’ and when she drunk her self before her bridal dinner crying and holding a letter (possibly from Gatsby) in another hand saying ‘Tell ‘em all Daisy’s change her mind (Fitzgerald, p. 51)’.Wealth is seen as a way to relieve the pain of being left alone. By marrying a wealthy man, Daisy can more easily mend her broken heart. She had been able to ‘moved with a fast crowd (Fitzgerald, p.52)’ and able to maintain her reputation. Money is portrayed as a way out of loneliness. Wealth is displayed as a road towards happiness and fulfillment.Hedda Gabler is actually a play written by Ibsen showing how much societal pressure and norms confine a person into a specific stereotype. The story revolves around Hedda, who is newly married to George Tesman, an aspiring professor. Hedda is described as the daughter of an aristocratic General Gabler.It is apparent from the course of the dialogue between Hedda and the other characters that she does not love her husband. It also seems as if she only married him because he can at least provide her with her needs although it may not be enough. Hedda, all throughout the story manipulated other characters into doing her will. George, Aunt Julie and the other characters wants to please her and they do their best to reach her upper-class taste.Hedda has everything she need. Nonetheless, since she has to marry to maintain her social status, she chose to marry George Tesman. Tesman is a very bookish person. H e even researched from libraries despite being on honeymoon. He relay his amazement of the museums and libraries to Aunt Julie, stating ‘Notes, documents- people didn’t know existed (Ibsen, p.13)’. Tesman is willing to do everything for Hedda yet she cannot be satisfied.The advantage of wealth lies on the respect and the treatment that Hedda receives from other people despite her unusually rude and manipulative character. Despite the fact that Aunt Julie was hurt when Hedda mistaken her new hat to be old and to belong to the maid, she still treat Hedda nicely. Aunt Julie stated ‘she’s lovely all her life (Ibsen, p.19)’.Thea also remark about Hedda’s difference with her status in the line ‘we’ve not been close†¦ you were always, in a different world from me, socially (Ibsen, p. 26)’. This shows that even though both are women of the same era, Thea still recognizes the fact that Hedda is different ‘sociallyà ¢â‚¬â„¢. Being a daughter of a respected and powerful general gives her enough freedom and authority, bestowed by the society, to be regarded more powerful than the other women.

Statement of Facts: The Burbank Police Department, upon receiving tips from informants, conducted a drug trafficking investigation upon the respondents. Extensive surveillance operation was made on respondent’s three residences and several cars. After sufficient evidence was gathered an officer prepared an application for a warrant to search respondent’s three residences and several vehicles.A search warrant which is facially valid was issued by the judge after examining the supporting affidavits and documents. The search later on yielded large quantities of drugs and other evidence. Respondents were eventually indicted for federal drug offenses. They then filed motions to suppress the evidence seized by reason of the defecti ve warrant. After an evidentiary hearing, the District Court granted the motions in part and concluded that the affidavit was insufficient to establish probable cause.It also concluded that the officer who applied for a search warrant had acted in good faith but rejected their argument that the Fourth Amendment Exclusionary Rule should not apply where the evidence is seized in reasonable and good-faith reliance on a search warrant. The Holding/Decision of the Court: The Fourth Amendment exclusionary rule should not be restrictively applied so as prevent the prosecution from presenting pieces of evidence obtained by officers who acted in reasonable reliance on a search warrant issued by a detached and neutral judge but ultimately found to be invalid and unsupported by probable cause. Reasons/RationaleIn holding in favor of the law enforcement officers, the Supreme Court ruled that the Fourth Amendment Exclusionary Rule was not designed to serve as a personal constitutional right of t he injured person. The use of the evidence taken during an unlawful search does not necessarily constitute a violation of the Fourth Amendment rather the exclusionary rule merely seeks to safeguard Fourth Amendment right by deterring officers from conducting unlawful searches. In determining whether the exclusion of evidence is an appropriate sanction, the court weighed the costs and benefits of preventing the use of evidence illegally obtained.According to the court, the upholding of the Fourth Amendment Exclusionary Rule has serious repercussions for the truth-finding functions of the judge and the jury. This principle has allowed defendants to go free or receive reduced sentence even if they are guilty. The indiscriminate application of this rule hinders and hampers the efficient and effective administration of justice. The court reasoned that the search warrant in this case was issued by a judge after application by a seasoned narcotics investigator. The affidavits were even reviewed by Deputy District Attorneys before it was submitted to the State Superior Court Judge.It stressed that the warrant issued to the law enforcement officer prior to the search and seizure of the pieces of evidence provides a more reliable safeguard against improper and illegal searches compared to the hurried and often impartial judgment of a law enforcement officer. Indeed, there may be differences in opinion insofar as determining whether there is probable cause for the issuance of a warrant, but we a ll agree that search with a warrant is still better than search without a warrant. ,Moreover, according to the Supreme Court, it would not be in keeping with the administration of justice if the law enforcement officers who have diligently conducted their investigation and prepared the necessary affidavits to be punished for the errors of judges. Although it is true that the reason behind the Fourth Amendment Exclusionary Clause is to deter police misconduct and to encourage the law enforcement officers to respect the Fourth Amendment rights of the people, the rule should not be strictly applied to hinder the enforcement of law and order.To suppress therefore the evidence obtained based on the reasonable and good-faith reliance on a search warrant would not be in keeping with the spirit and purpose of the Fourth Amendment Exclusionary Rule which is to render inadmissible any evidence obtained in substantial and deliberate violation of the Fourth Amendment. The purpose of this policy is to force the law enforcement officers to respect the people’s Fourth Amendment right not to punish the law enforcement officers for the errors of a judge.But the Supreme Court also clarified that different result will be reached if the warrant in this case was obtained after the law enforcement officers have misled the judge by indicating in the Affidavit submitted to the judge information that the affiant knew to be false or would have known to be false or if the judge gravely abused his discretion in issuing the warrant. In these cases, suppression of the evidence is the appropriate remedy. Suppression may also be the appropriate remedy if the warrant on its face is so defective that it clearly appears that there was no probable cause for its issuance.Concurring Opinion of Justice Blackmun Justice Blackmun agrees with the finding of the majority that evidence obtained in violation of the Fourth Amendment by officers acting in objectively reasonable reliance on a search warrant issued by a neutral and detached judge need not be excluded. He however stressed that the statements made by them in this case is provisional in nature. This should not be taken as an absolute rule as every case will have to be evaluated in the light of its peculiar fights and circumstances.Dissenting Opinions of Justice Brennan and Justice Marshall In their dissenting opinions, Justice Marshall and Justice Brennan expressed their apprehension about the gradual erosion of the constitutional right of the people under the Fourth Amendment. Abortion can be done at many different stages of the pregnancy and most people’s opinion on abortion differs with their thoughts of when during the pregnancy should it be ok to abort.I believe that abortion should always be legal because no one person has the right to tell a woman that she must have a child, even if it was a mistake. Accidents happen whether it be the condom tears, the birth control does not work, or even the rare cases where a woman gets pregnant without actually having sex. We are human beings, we are not perfect in anyway shape or form, we are bound to make mistakes and I don’t believe that this ki nd of mistake should automatically change your life without giving you an option if it does.I can see where people could get upset from someone performing an abortion when you can actually see fetus, but I don’t see where they could get upset when the egg is just fertilized or is just a collection of cells. One human being has over 50 trillion cells in their body and you shouldn’t get mad if a woman decides to kill about 100 of them (Human Body). That is my viewpoint; women should be allowed to get an abortion before a certain time in the pregnancy. I don’t view a collection of cells that is not any type of developed organism yet to be a living person.There are also other circumstances that I believe make abortion a valid choice for a woman. Becoming pregnant at a young age can honestly ruin your life and make it so you can never go back to the way things were and fulfill your dreams that you once had.Not being financially stable to support a child is also a big problem because every child deserves to have a safe and healthy childhood. The Early Childhood Experiences Curriculum, hence all Grade One teachers are expected to implement it. Teachers are also encouraged to make use of local songs, games, dances and indigenous materials to enrich the curriculum. It is hoped that the Early Childhood Experience for Grade One will greatly benefit the children and strengthen efforts to make the schools child-friendly. Theoretical Framework This study is anchored on Edward Thorndike’s, Jerome Bruner’s, and B.F. Skinner’s Theories of Learning. These theories enabled the researcher in the conceptualization of this work. The Law of Readiness as advocated by Thorndike is associated with mind set. It states that when an organism is prepared to respond to a stimulus, allowing doing so would be satisfying while preventing him would be annoying. This law works well in this study because the children is mentally ready to learn. The Law of Exercise states that the constant repetition of response strengthens its connection with the stimulus, while disuse of response weakens it. The exercises given to the children using a modifiable connection like instructional materials enables them to acquire the learning easier and faster because the responses will be utilized, the stronger the connection to be developed. Thus, when a modifiable between a stimulus and a response has been made, it is strengthened if its results in satisfaction as the Law of effect proves. Jerome Bruner’s (1915) theory of Instrumental conceptualization is also applied as it involves (3) three simultaneous processes as: Acquisition, Transformation and Evaluation. This theory of learning believes that the acquisition of whatever form of knowledge acquisition, who selects structures, retains and transforms information. Teaching without the use of proper strategic plans will result to failure. Through School Readiness Assessment Test (SReA), pupils will acquire knowledge through different techniques used by the researchers. Hence, learning to read is facilitated by Skinner’s Theory. Conceptual Framework This study focused on the evaluation of academic performance of Grade One pupils with and without Early Childhood Experience of Sto. Nià ±o Elementary School. The independent variable consist of School Readiness Assessment Test (SReA) for children with and without Early Childhood Experience while the dependent variable is the academic performance of the respondents in terms of the following: Sensory Discrimination, Concept Formation, Numeracy, Reading Readiness and Construction and Visual Motor Integration.
